National Association of Realtors (NAR) Settlement and How if May Affect Our Clients

On August 17th, 2024, changes are coming concerning the way we may represent and be compensated by our clients. 

First and foremost, commissions paid to real estate agents have always been negotiable.  And that will continue.  What is changing, however, is the manner in which we can communicate this compensation to the public.  Buyer agent compensation has historically be negotiated by the Listing Agent when the property is listed for sale.  The Listing Agent has explained and negotiated the full commission on the potential sale of a property with the owner.  That commission is split with both agents and their managing brokers.  And that percentage of commission is based in most cases on the sale price of the property.  

How this compensation is communicated with the Buyer's Agent is changing.  It will no longer be acceptable to have the Buyer's Agent compensation listed out in the MLS information sheet for the property for sale.  In order for the Buyer's Agent to know and understand what the offer of compensation to them, they will need to contact the Listing Agent.  

Buyer's Agents will not be legally allowed to show any buyer any property (except an open house) without there first being a current, written buyer agency agreement in place.  It is the duty and responsibility of the Buyer's Agent to inform their client (the buyer) if they will be compensated by the seller, or if the buyer will be obligated, per the agency agreement, to pay the buyer's agent's commission.  The Buyer may opt our of looking at a property if the seller is not offer any commission to their buyer's agent.

This is an important topic of conversation that we will have with each of our clients at our first meeting.  We will not be looking at properties with our buyers until an agency agreement has been signed.  It is now a mandatory requirement according to national real estate law.
